Dispute Resolution Policy
This policy deals solely with disputes that have arisen from the privacy conduct of an eTrust certified website. Disputes alleged to arise from trademark and other infringements should be addressed by court action, arbitration or other means.
If the eTrust certified company and their website user are unable to find a satisfactory solution to a dispute then they may contact eTrust to have their complaint resolved. Website users also have the right to contact us of their own accord without notifying the eTrust Certified company.
eTrust Board will review the breach of the License Agreement
and will check to see whether the company has handled the complaint in a proper manner, and if suitable suggest a solution.
The dispute will be conducted in accordance to terms of our Liensee Agreement, the information provided by the certified company during the application process, and personal judgement.
Both parties must take no longer than five (5) business days to reply to queries by the eTrust Board, to facilitate the speedy resolution to the dispute.
The dispute resolution process will only cease when the Board has made its decision, or we have received satisfactory evidence from both parties that the dispute has been resolved mutually.
The Board's final decision will be binding on both parties but will not prevent either from going to court if they deem that necessary. If the complaint is upheld then depending on its severity we have the right to withdraw the company's eTrust certification.
It is important to note that eTrust does not offer legal advice to those in dispute over the company's privacy conduct.
Either party has the right to approach the appropriate law courts without notifying us of any dispute. They are not binding to approach us before they approach the law courts.
We do not, and will not, participate in the administration or conduct of any proceeding before a Law Court. In addition, we will not be liable as a result
of any decisions rendered by the English Law Courts. eTrust will comply with English Court Orders when a dispute is settled through the legal process.
